If the Assumed Name is not submitted through the e-filing system and received by our office by 2:00 pm, it is not guaranteed to be recorded by the end of that day.

• Every question on the form must be answered except for #5.  If the address for #5 is the same as in #4, then #5 can be left blank.  If the form being used is not the form created by the Secretary of State’s office, it must have all of the information that the Secretary of State’s form is requesting.
• If the Assumed Name is an LLC, Corporation or Limited Partnership, then the owner of the Assumed Name must also be an LLC, Corporation or Limited Partnership that is established with the NC Secretary of State’s office and the SOS ID number must be present on the form.
• The Assumed Name forms that are recorded in our office are not uploaded to the Secretary of State’s office until that day’s indexing is completed and closed out.  It will upload at around 5:30 pm on the day it is closed out.
• We will not reject documents due to misspellings.  We will record the document and index it exactly as it is seen on the document.
• We will not verify whether or not the SOS ID number that is listed for the owner of the Assumed Name is correct.  We will index it exactly as it is seen on the document and that is what will be uploaded to the Secretary of State’s office.
• Non-conforming rules do apply to the Assumed Name documents recorded in our office.  If anything about the document is non-conforming, the $25.00 statutory fee will be applied.
